Rite Aid Mobile App Terms and Conditions
Please read these Terms and Conditions before downloading, installing or using this App.
Your use of the Rite Aid Mobile App (the “App”) constitutes your agreement to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not access or use this App. We may at any time change the App and these terms and conditions. Your use of the App following any such change constitutes your acceptance of the change. For this reason, we encourage you to review these Terms and Conditions whenever you use the App.
You are responsible for payment of any costs or expenses incurred as a result of downloading and using the App, including any operator network and roaming charges. Please check with your service provider for details. If you are not the bill payer for the mobile telephone or handheld device used to access the App, you will be assumed to have received permission from the bill payor to use the App.
Protecting Your Personal Information.
License; Scope of Use.
Subject to these Terms and Conditions, Rite Aid grants you a limited, non-transferable, irrevocable license to view, use and download a single copy of the App for your informational, personal, non-commercial use (the “License”) on any device that you own or control. The License does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the App. You may not copy (except as expressly permitted by these Terms and Conditions), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof. Any attempt to do so is a violation of the rights of Rite Aid or its licensors. You may not use this App for any purpose (i) which would be contrary to Rite Aid’s business interest, or (ii) to Rite Aid’s actual or potential economic disadvantage in any respect, including using the App to develop a competing application. All rights not specifically and expressly granted under the License are reserved by Rite Aid.
The App is licensed, not sold. The License confers no title to or ownership in the App and should not be construed as a sale of any rights in or to the App. Rite Aid may terminate, change, suspend or discontinue any aspect of the App, including the availability of any features of the App, at any time and in Rite Aid’s sole discretion.
Trademark and Copyright.
"Content" refers to any materials, documents, images, graphics, logos, design, audio, video and any other information provided from or on our App, including trademarks, service marks and logos. All of the Content on the App is subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by Rite Aid or one of its affiliates or by third parties who have licensed their materials to us.
Use of Content.
You may use the Content of the App only for your personal, non-commercial use. The Content is for informational purposes only and is not a substitute for professional medical advice, diagnosis or treatment. We do not provide medical advice and suggest you consult your health care provider with questions concerning any medical condition. You shall not modify or alter the Content in any way, or delete or change any copyright or trademark notice. Rite Aid reserves complete title and full intellectual property rights in any Content you download from the App.
Links to Third-Party Sites.
This App may contain links to websites (“Sites”) that are owned or operated by third parties. Such links are provided for your reference only; we do not control such Sites and are not responsible for their content. We reserve the right to terminate a link to a third-party Site at any time and the fact that we provide a link does not mean that we endorse, authorize or sponsor that Site.
We welcome your comments, notes, messages, ideas, feedback, suggestions or other communications (collectively, "Comments") concerning the App, which shall be and remain the exclusive property of Rite Aid. Your submission of any such Comments shall constitute an assignment to Rite Aid of all worldwide rights, titles and interests in all copyrights and other intellectual property rights in the Comments. Rite Aid will be entitled to use, reproduce, disclose, publish and distribute any material you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, only send us comments which you desire to assign to us.
THE APP AND THE CONTENT ARE PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULL EXTENT PERMITTED BY LAW, RITE AID DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EITHER EXPRESS OR IMPLIED WITH RESPECT TO THE APP AND THE CONTENT, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FOR ANY MERCHANDISE OFFERED ON THIS APP. THIS DISCLAIMER DOES NOT APPLY TO ANY PRODUCT WARRANTY OFFERED BY THE MANUFACTURER OF THE ITEM.
No term or provision of these Terms and Conditions shall be deemed waived and no breach excused unless such waiver or consent is in writing and signed by the party claimed to have waived or consented.
Rite Aid reserves the right, in its sole discretion, to terminate your access to the all or part of the App, with or without notice, for any reason or no reason, including, without limitation, your violation of these Terms and Conditions.
Governing Law and Venue.
By accessing and using this App, you agree that your access and use is subject to these Terms and Conditions as well as applicable laws, as governed and interpreted pursuant to the laws of the Commonwealth of Pennsylvania. Any litigation arising out or in connection with your use of this App shall be exclusively in the state or federal courts located in Cumberland County, Pennsylvania.
Severability; Entire Agreement.
If any part of this agreement is ruled to be unenforceable, then such part shall be limited or eliminated to the minimum extent necessary, with the remainder of agreement remaining in full force and effect. The Terms and Conditions constitute the entire agreement between us governing your use.
2. USER CONSENT.
3. TYPES OF DATA WE COLLECT.
Rite Aid collects Personal Data and Anonymous Data from you when you use the Mobile App.
3.1 Personal Data.
“Personal Data" means data that is personally identifiable to you, including your name, address, telephone number, e-mail address and RiteAid.com Login ID, as well as any other non-public information about you that is associated with, or linked to, such data. Your Personal Data may include “protected health information” (“PHI”) subject to privacy and security protections under the Health Insurance Portability and Accountability Act (“HIPAA”). For example, your prescription number and medication information would constitute PHI. For more information about how Rite Aid safeguards PHI in compliance with HIPAA, please see Rite Aid’s Notice of Privacy Practices (https://www.riteaid.com/legal/patient-privacy-policy). We collect the Personal Data such as the following in connection with the Mobile App:
(i) When you create an account with us, we will collect your first and last name, middle initial, e-mail address, password, address, telephone number and date of birth;
(ii) We may also collect certain Personal Data related to your prescription management, including prescription numbers and medication information;
(iii) We may periodically collect the GPS data (i.e., location data) and the device information of the handheld mobile device on which the Mobile App is installed. We may collect information (“Mobile App Information”) about your use of the Mobile App and the content you share with others, and associate that information with your account. We use this information, in part, to provide you with location-based information (such as finding a Rite Aid store near you), to personalize your user experience, for marketing purposes as described in this Policy, and to improve the Mobile App. You expressly consent to our collection and use of your Mobile App Information, as described above.
3.2 Other Types of Data
(b) IP Addresses, Phone Serial Numbers and Phone Numbers. IP addresses, phone serial numbers and phone numbers are used by your mobile device every time you are connected to the Internet. Your IP address is a number used by computers on the network to identify your mobile device. IP addresses are automatically collected by our web server as part of demographic and profile data (“Traffic Data”) so that certain information (such as the web pages you request) may be sent to you.
(c) Referer. A “Referer” is the information transmitted by a web browser or application that references the Web URL you linked from, and is automatically collected by our web server as Traffic Data. We reserve the right to use this information to identify broad demographic trends that may be used to provide information tailored to your interests. You will not be personally identified from this information.
(d) System Information. System information that we collect as part of Traffic Data includes time, the type of web browser or phone being used, the operating system/platform, phone network and CPU Speed (“System Information”). System Information is sent automatically by your web browser when you are connected to a website or mobile application. We reserve the right to use System Information for purposes of identifying broad demographic trends. System Information may also be used to provide information appropriate for your mobile device. You will not be personally identified from this information.
4. USE OF DATA WE COLLECT.
4.1 Use of Personal Data.
Rite Aid uses and stores your Personal Data in order to provide the Mobile App to you, and to analyze and improve upon the operation of the Mobile App. Personal Data may also be used for operational and administrative purposes of the Mobile App.
4.2 Use of Personal Data for Requested Transactions.
Rite Aid uses and stores Personal Data in order to fulfill transactions that you have requested through the Mobile App, such as transfer of a prescription.
4.3 E-mail Communications.
If you register and provide your e-mail address, we may send you administrative e-mails. If you wish to opt out of these e-mails, you may do so by following the “unsubscribe” instructions provided for you in such e-mail.
4.4 User Testimonials.
We value your feedback on, and appreciate any testimonials about, our Mobile App. If you send us any such feedback or testimonials, they shall be deemed, and shall remain, the property of Rite Aid, and shall not be considered confidential.
5. DISCLOSURE TO THIRD PARTIES.
5.1 Disclosure to Third-Party Service Providers.
We may share your Personal Data with, or allow your Personal Data to be collected by, third-party service providers: (a) to provide you with the services that we offer you through our Mobile App; (b) to conduct quality assurance testing; (c) to facilitate creation of accounts; (d) to provide technical support; or (e) to provide other services to us or you. These third-party service providers are not authorized by us to use your Personal Data other than to provide the services requested by Rite Aid. You expressly consent to the sharing of your Personal Data with our contractors and other service providers as described herein.
5.2 Legal Disclosures.
Regardless of any choices you make regarding your Personal Data (as described below), Rite Aid may disclose Personal Data if it believes in good faith that such disclosure is necessary to: (a) comply with relevant laws or to respond to subpoenas or warrants served on Rite Aid; (b) protect or defend the rights or property of Rite Aid or users of the Mobile App; or (c) assist in the detection and investigation of fraud and other illegal activity.
5.4 Other Disclosures.
6. YOUR CHOICES REGARDING YOUR PERSONAL DATA.
6.1 Choices Regarding Promotional Communications.
6.2 Changes to Personal Data.
You may change any of your Personal Data in your account by editing your profile. You may request deletion of your Personal Data by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, however, such information may continue to be retained on our backup and archival systems. Accordingly, when you request that we remove your information from our systems, copies may remain on our systems for a certain time. Please note that such requests are handled promptly, but it does require some time to complete the request. Until that time, your information may continue to be used in accordance with the terms of this Policy.
6.3 Sharing of Information.
We will never sell, rent, or license Personal Data to a third party without your permission, except as otherwise provided in this Policy.
Rite Aid uses a variety of reasonable security technologies and procedures to help protect your Personal Data. We also require you to enter a password and other authenticating information to access your account. Please do not disclose your account password to unauthorized people.
The Mobile App may contain advertisements and/or links to websites owned or operated by third parties. Such links are provided for your reference only, and Rite Aid has no responsibility or liability for the privacy practices or the content of those websites.
