    Rite Aid Rewards Terms

    The Rite Aid Rewards program (“Rite Aid Rewards”) is a no cost customer loyalty program, operated and sponsored by Rite Aid  (“Rite Aid” or “us”), which allows participants (“Members” or “you”) to earn points (“Points”) by purchasing specific promoted products from Rite Aid stores, our website (www.riteaid.com), or the Rite Aid mobile app. Members with at least 1,000 Points can convert their Points into merchandise credit called “Rite Aid Rewards BonusCash” (“BonusCash”).  Members may also receive other offers (“Offers”), defined below.

     

    The following terms and conditions (these “Rewards Terms”) apply to your access to and participation in Rite Aid Rewards, including purchases made in connection with the program, and the use of BonusCash. PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR PARTICIPATING IN RITE AID REWARDS, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE AS DESCRIBED BELOW. 

     

    Rite Aid may, in our sole discretion, can cancel, change, suspend or modify any aspect of Rite Aid Rewards (including the availability of BonusCash and Offers) and/or all or any portion of these Rite Aid Rewards Terms at any time, without notice to you. Additionally, Rite Aid may offer different promotions, rewards, and/or benefits at different times and locations in conjunction with the program.

     

    Your participation in Rite Aid Rewards, including your conversion of points and redemption of BonusCash or Offers, is considered acceptance of these Rite Aid Rewards Terms (including any subsequent changes or modifications), so it is important to check the Rite Aid Rewards Terms periodically. IF YOU DO NOT AGREE TO THE CURRENT RITE AID REWARDS TERMS, YOU MUST STOP PARTICIPATING IN RITE AID REWARDS.

     

    In addition, these Rewards Terms complement and incorporate by reference Rite Aid’s website Terms & Conditions (the “Site Terms”) and Privacy Policy. In the event of any conflict between the Rite Aid Rewards Terms and the Site Terms, the Rite Aid Rewards Terms control.

     

    PLEASE READ THESE REWARDS TERMS CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS. THE AGREEMENT INCLUDES A CLASS ACTION WAIVER AND REQUIRES BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, AS SET FORTH BELOW. IF YOU DO NOT AGREE WITH ANY OF THESE REWARDS TERMS, DO NOT ENROLL IN, USE, OR ACCESS (OR CONTINUE TO ACCESS) RITE AID REWARDS.

     

    ELIGIBILITY AND ENROLLMENT

     

    There are no membership fees associated with Rite Aid Rewards, and no initial purchase is required. To join Rite Aid Rewards, you must be a legal resident of one of the forty-eight (48) continental United States or the District of Columbia and be thirteen (13) years of age or older.  If you are between 13 and 18 years old, you confirm by participating in Rite Aid Rewards that you have obtained permission from your parent or legal guardian.  If you are between 13 and 18 years old, you may participate in Rite Aid Rewards only under the supervision of your parent or legal guardian who has agreed to be bound by these terms.    Employees of Rite Aid and Bartell Drugs are eligible to participate, but may only use their membership in Rite Aid stores; they may not earn Points or redeem BonusCash at Bartell Drugs. 

     

    You may enroll in Rite Aid Rewards online at RiteAid.com, in the Rite Aid app, or at a participating Rite Aid location. Customers who sign up in-store can submit their phone number to begin earning Points right away.  However, to complete enrollment, Members must create a digital account, either through the RiteAid app or RiteAid.com (“Digital Account”).      A Rite Aid Rewards Digital Account is required to convert Points to BonusCash, and to redeem other Offers.

     

    Members of Rite Aid’s previous loyalty program, wellness+, are automatically enrolled in Rite Aid Rewards.  However, these members who do not have a digital account must complete their enrollment at RiteAid.com or in the Rite Aid app in order to enjoy all benefits of the program.

     

    Rite Aid Rewards is intended for personal use only. Commercial use is prohibited. You may only have one Rite Aid Rewards account.  Your Rite Aid Rewards account, BonusCash, and Offers are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. Each account must be associated with a phone number, and each number may only be associated with a single account. You agree to provide true, accurate and current contact information, and Rite Aid is not responsible for your inability to receive or redeem benefits or other loss if you fail to do so.  Please keep your contact information up to date so that we can provide you with information concerning the program and your account status.

     

    USING YOUR DIGITAL ACCOUNT

     

    You can view and manage your Rite Aid Rewards activity through your Digital Account, which is accessible on riteaid.com/rewards or the Rite Aid mobile app. 

     

    Your Digital Account includes such activity as your Points and BonusCash balances, BonusCash redemption history and current Offers and Promotions.  Your Digital Account is also where Members may convert Points to BonusCash, as discussed further below. You may also track your Points or convert Points to BonusCash by calling 1-800-748-3243.  To protect your privacy, pharmacy information, including prescribed medications, is not included or visible in your Digital Account.

     

    To receive the benefits discussed herein during an in-store purchase, you must provide your phone number,  or digital account number at the time of purchase so that the transaction is associated with your Digital Account.  

     

    For online and in-app purchases, you must be logged into your Digital Account at the time of purchase to earn points and apply any BonusCash balance you may have.

    BONUSCASH

     

    Earning Points

     

    Members receive Points on qualifying purchases made in Rite Aid store locations, Rite Aid website, Rite Aid mobile app or through select third party ecommerce marketplaces. Points are calculated based on purchase price minus coupons, and discounts, and before taxes, shipping costs, or other fees are applied.

     

    Points are calculated as follows:

    -          10 Points per $1 spent on eligible products (exclusions apply).

    Government Funded Prescriptions

    -          10 points for each $1 co-pay up to a maximum of 250 points per eligible prescription pick-up (available only in certain states).

    Non-Government Funded Prescriptions

    -          250 Points per eligible prescription pick-up of up to 30-day supply (available only in certain states).

    -          750 Points per eligible prescription pick-up of a 31+ day supply (available only in certain states).

    Immunizations

    -          250 Points per eligible immunization given at an in-store pharmacy location (available only in certain states).

     

    Points and offers for pharmacy services (including prescription pick-ups and immunizations) are limited to 37,500 points ($75 in total value) annually per account and are not available in NY, NJ or where otherwise prohibited by law.  At no time, can any Member receive more than 7,500 points ($15 in total value) per any pharmacy services transaction.   Points are not available for controlled substances pick-up.    

     

    Rite Aid may make modifications to this list, including adding eligible activities or determining that an activity is no longer eligible to earn credits, at any time.

     

    The following restrictions apply for earning Points:

    -          Points will not be awarded for purchases made prior to enrollment in Rite Aid Rewards.

    -          Points are not available for the purchase of the following items and services (together, “Excluded Items”): tobacco products, alcohol, lottery tickets, gift cards, licenses, money orders, money transfers, newspapers, stamps, other mail services, dairy products, prescriptions in NY or NJ, other items prohibited by law, or for the payment of prescription copays, tax, delivery services, or shipping costs.

    -          The products on which Points may be earned are determined by Rite Aid, in its sole discretion, and may change from time to time without notice.

    -          Transferred prescriptions may not be eligible to accumulate Points in MA, OR, WA, NY and NJ and where otherwise prohibited by law.

    -          Points are not available for COVID-19 immunizations.

     

    Rite Aid may at times offer promotions that provide Points or BonusCash based on the purchase of eligible products or other activities.  These opportunities may change at any time and without notice.

    Rite Aid Rewards 65+

     

    Through its Rite Aid Rewards 65+ program (formerly wellness65+), Members  can receive  5X (five times) Points on eligible front-end merchandise purchased in-store on designated dates. To qualify, you must be a Member and at least 65 years old on the date of enrollment. Customers must enroll in-store and provide proof of age to qualify.

     

    Converting Points to BonusCash

     

    Once you earn a threshold number of Points, you may convert the Points to BonusCash, which may be used at Rite Aid for the purchase of eligible products. Points cannot be converted to BonusCash once they expire.

     

    Members can convert accumulated Points into BonusCash in one of three increments:

    ·       1,000 Points = $2 BonusCash

    ·       2,000 Points = $4 BonusCash

    ·       3,000 Points = $6 BonusCash

     

    To convert Points to BonusCash, log into your Digital Account through RiteAid.com or the Rite Aid app and follow the applicable instructions. BonusCash will be issued upon submission of a request to convert points, whether manually or by selection of points threshold for automatic conversion of points, and will expire thirty (30) days from the issue date.  If you need assistance, please call 1-800-RITEAID (1-800-748-3243).  Any and all taxes consequences are the sole responsibility of the Member.   

     

     

    Points expire 90 days from issuance.  BonusCash expires 30 days from issuance and Members must convert their points to BonusCash through their digital account at RiteAid.com.

     

     

    Redeeming BonusCash

     

    BonusCash is promotional in nature, has no cash value, and is not redeemable for cash—it can only be applied toward the purchase of eligible merchandise sold at Rite Aid stores, at www.riteaid.com, and on the Rite Aid app. BonusCash cannot be used toward the purchase of Excluded Items, prescriptions, for the payment of prescription copays, tax or shipping costs, or for buy-online-pick-up-in-store purchases.  BonusCash cannot be used for the purchase of third party products or services such as delivery services or ecommerce marketplaces. Your BonusCash balance will be applied in any amount up to your purchase total after any discounts and before tax. BonusCash cannot be applied to previous purchases, even if on the same day.   

     

    You can redeem BonusCash during the checkout process by providing either your Rite Aid Rewards account number or the phone number associated with your account. Although Rite Aid may as a courtesy inform you at checkout that you have BonusCash available for redemption, you may choose to use or save your BonusCash for use on a later date, subject to its expiration date.

     

    Redeeming Digital Coupons

     

    Digital coupons can only be applied toward the purchase of eligible merchandise sold at Rite Aid stores, at www.riteaid.com, and on the Rite Aid app. Digital coupons cannot be used toward the purchase of Excluded Items, prescriptions, for the payment of prescription copays, tax or shipping costs, or for buy-online-pick-up-in-store purchases. Digital coupons cannot be used for the purchase of third party products or services such as delivery services or ecommerce marketplaces. Your digital coupons balance will be applied in any amount up to your purchase total after any discounts and before tax. Digital coupons cannot be applied to previous purchases, even if on the same day.   

     

    You can redeem digital coupons during the checkout process by providing either your Rite Aid Rewards account number or the phone number associated with your account. 

     

    Returns

     

    Items purchased using only BonusCash may only be exchanged for a reimbursement of the applicable BonusCash into your Digital Account (not cash or credit). Where you purchased an item using both cash/credit and BonusCash, you will first be refunded BonusCash (up to the total amount redeemed) and then any cash/credit to equal the total refund amount. Refunded BonusCash will expire 30 days from the date it is issued.

     

    If you void or return a purchase for which you received Points or BonusCash, those Points or BonusCash will be deducted from your account at the time of return.  Where these Points were converted to BonusCash before the time of the return, or if this BonusCash has been redeemed, then the Point value of the purchase will be deducted from the points balance in your account.  In either case, this can potentially result in a negative Point or BonusCash balance, which you may restore by purchases of other qualifying merchandise.

     

    ADDITIONAL BENEFITS OF THE PROGRAM

     

    Members may be eligible for additional savings, discounts, exclusive pricing, and promotions offered by Rite Aid as part of Rite Aid Rewards (together, “Offers”). Those Offers may be governed by other terms and conditions which may include but are not limited to Excluded Items, combinability with other Offers and promotions.  Offers may not be applied to previous purchases.

     

    Offers may be sent to Members via email, register receipt, notifications, or mail, or they may be automatically loaded directly onto Members’ Digital Account or by other means and channels.  When an Offer is not loaded onto a Member’s Digital Account, the Member must present proof of the Offer at checkout to receive the Offer; proof of the Offer shall be accepted in Rite Aid’s sole discretion.

     

    Digital Coupons (formerly Load2Card) is our convenient digital coupon tool that lets Members select coupons online, load them directly into their Digital Account and redeem them in-store or online.  Members can track their Digital Coupons through their Digital Account.

     

    Rite Aid reserves the right to limit the number of Offers loaded into a given Digital Account, and to add, modify or delete any Offer without prior notification. When a Member returns an item that was purchased using an Offer, the Offer will not be returned to the Member’s account.  Rite Aid is not responsible for unintended redemption of any offer loaded to a Member’s Digital Account. Each Offer must be redeemed in a single transaction.

     

    ADDITIONAL RESTRICTIONS ON POINTS, BONUSCASH, OFFERS, AND OTHER BENEFITS

     

    Points, BonusCash, and Offers, other benefits available via Rite Aid Rewards (together, “Program Benefits”) and third‐party manufacturer Coupons are subject to our Coupon Acceptance Policy and applicable law. See our FAQs to learn more.

     

    Program Benefits have no cash value, are not redeemable for cash, gift certificates or gift cards, are purely promotional, and do not constitute property of any Member. No portion of any payment for purchases qualifying for Program Benefits constitutes consideration paid for any of the foregoing. Rite Aid reserves the right to limit the availability and redemption of specific Program Benefits.

     

    Program Benefits may not be redeemed in the same purchase in which they were earned. They also may not be used toward the purchase of Excluded Items (defined above), or toward purchases through third party services.  Additional local exclusions may apply.

    You are solely responsible for any tax consequences that may result from your participation in Rite Aid Rewards and your receipt or use of Program Benefits.

     

    Dispute Resolution— Class Action Waiver, Arbitration Agreement, and Choice of Law

     

    PLEASE READ THIS SECTION CAREFULLY – IT MAY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO MAINTAIN A LAWSUIT IN COURT, THE RIGHT TO HAVE A JURY HEAR YOUR CLAIMS, AND THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM. IT CONTAINS A CLASS ACTION WAIVER, AND PROCEDURES FOR PRE-ARBITRATION DISPUTE RESOLUTION, MANDATORY BINDING INDIVIDUAL ARBITRATION, AND MASS ARBITRATIONS.  If you do not agree to the provisions in this section, you may opt out, but only by following the procedures set forth in the OPT-OUT OF AGREEMENT TO ARBITRATE subsection below.

     

    The terms in this Section apply to any and all claims, disputes, or controversies that have arisen or that may arise between you and Rite Aid on any basis and regardless of when such Claims arose, including relating to these Rewards Terms, your participation in Rite Aid Rewards or wellness+, or your earning and/or use of BonusCash, Offers, or Points (each, a “Claim”).  “Claims,” as used herein, is defined as broadly as possible to include any claim related in any way to any purchase you have ever made or will make at or from Rite Aid, your participation in Rite Aid Rewards or wellness+, your use of our website (www.riteaid.com) or the Rite Aid mobile app; content provided on our website or the Rite Aid mobile app; our advertising; marketing communications (including emails and SMS); and our use of data provided on our website or the Rite Aid mobile app.

     

    WE BOTH AGREE TO ARBITRATE:

     

    To the fullest extent permitted by applicable law, you and Rite Aid agree to resolve any and all Claims through final and binding individual arbitration.  Arbitration is less formal than a lawsuit in court and seeks to resolve disputes more quickly. Instead of a judge or a jury, the case will be decided by a neutral arbitrator who has the power to award the same damages and relief that a court can. 

     

    This arbitration agreement shall not apply in the following limited circumstances:

     

    SMALL CLAIMS COURT: In lieu of arbitration, either you or Rite Aid may assert individual claims in small claims court consistent with the jurisdictional and dollar limits that may apply, so long as the matter remains in such court and advances only on an individual, non-class, non-representative basis.

     

    INTELLECTUAL PROPERTY CLAIMS: Notwithstanding the other provisions in this Section, if you or Rite Aid has a basis to believe that the other party has in any manner violated or threatened to violate its intellectual property rights (for example, trademark, trade secret, copyright, or patent rights), the party may bring suit in a court of competent jurisdiction in the Middle District of Pennsylvania rather than through arbitration.

     

    In these circumstances, Rite Aid may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Rite Aid Rewards or intellectual property infringement without first engaging in arbitration or the pre-arbitration and informal dispute resolution processes discussed herein.

     

    CLASS ACTION WAIVER: To the fullest extent permitted by applicable law, you and Rite Aid agree that ANY CLAIM RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS, CLASS ACTIONS, AND ANY OTHER CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTIONS ARE NOT PERMITTED AND YOU AGREE TO GIVE UP THE ABILITY TO PARTICIPATE IN ANY SUCH ACTION.  To the fullest extent permitted by applicable law, you agree that you will not be a member of any putative or actual class in a class action brought by anyone else, nor will you seek to become a class representative. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not allowed.

     

    Notwithstanding anything to the contrary in these Rewards Terms or in the JAMS’ Rules (discussed below), disputes regarding the enforceability, revocability, or validity of the class action waiver may be resolved only by a civil court of competent jurisdiction and not by an arbitrator. In any case in which (i) the dispute is filed as a class, collective, or representative action, and (ii) there is a final judicial determination that all or part of such class action waiver is unenforceable, then the class, collective, and/or representative action, to that extent, must be litigated in a civil court of competent jurisdiction, but the portion of such class action waiver that is enforceable shall be enforced in arbitration. 

     

    PRE-ARBITRATION NOTICE AND INFORMAL DISPUTE RESOLUTION: Prior to commencing an arbitration proceeding, you must first send a notice describing your claim to our registered agent, CT Corporation, 600 N. 2nd Street, Suite 401, Harrisburg, PA 17101 (“Notice”). The Notice must include your name, address, telephone number, email address, sufficient information for Rite Aid to identify any transaction at issue; and a detailed description of (1) your dispute, (2) the nature and basis of your claims, and (3) the nature and basis of the relief sought.

     

    You and Rite Aid agree to negotiate in good faith about the dispute, including through an informal and individualized telephone conference should Rite Aid request one. You must personally appear at and participate in the telephone conference (if you are represented by counsel, your counsel may also participate). This process should lead to resolution of the dispute, but if for some reason it is not resolved within sixty (60) days after receipt of the Notice (which period can be extended by agreement of the parties), you may commence an arbitration.

     

    Compliance with and completing this informal dispute resolution process is a condition precedent to filing any demand for arbitration. A court shall have the authority to enjoin the filing or prosecution of arbitrations without first providing a fully complete Notice and participating in this informal dispute resolution process. Unless prohibited by applicable law, the arbitration provider shall not accept or administer any arbitration unless the claimant has complied with the Notice and informal dispute resolution process.

     

    ARBITRATION RULES AND PROCEDURES: The Federal Arbitration Act governs the interpretation and enforcement of this dispute resolution provision. Arbitration shall be initiated through JAMS. Any dispute, controversy, or claim arising out of or relating to these Terms shall be referred to and finally determined by arbitration in accordance with the JAMS Streamlined Arbitration Rules and Procedures (the “JAMS Rules”), which are available at https://www.jamsadr.com/rules-streamlined-arbitration/, in front of one arbitrator. If there is a conflict between JAMS Rules and the rules set forth in these Terms of Service, the rules set forth in these Terms of Service will govern.  For more information concerning JAMS’ procedures, see https://www.jamsadr.com or 1-800-352-5267.

     

    To initiate arbitration, you or Rite Aid must do the following:

     

    Write a demand for Arbitration. The demand must include a description of the claim and the amount of damages sought to be recovered. You can find a copy of a “Demand for Arbitration” at https://www.jamsadr.com;

     

    Send three copies of the “Demand for Arbitration”, plus the appropriate filing fee to your local JAMS office or to JAMS, 1717 Arch Street, Suite 3810, Philadelphia, PA 19103; and

     

    Send one copy of the “Demand for Arbitration” to the other party. If to Rite Aid, the copy must be sent to CT Corporation, 600 N 2nd Street Suite 401, Harrisburg, PA 17101

     

    Payment of all filing, administration and arbitrator fees shall be governed by the JAMS Rules.  Each party will bear their own costs of arbitration, including attorney’s fees, to the extent permitted by JAMS Rules.

     

    Arbitrations may be conducted by phone, video, or via document submission, or as agreed upon mutually by the parties, or to the fullest extent allowable by the arbitrator. Arbitration under these Rewards Terms shall be held in the United States in Camp Hill, Pennsylvania without regard to its conflict of laws provisions.  Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

     

    The arbitrator will decide the rights and liabilities, if any, of you and Rite Aid, and the dispute will not be consolidated with any other matters or joined with any other cases or parties, unless agreed by all parties. The arbitrator shall have the authority to grant motions dispositive of all or part of any claim. The arbitrator shall have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the Arbitration Rules, and these Rewards Terms. The arbitrator shall issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The award of the arbitrator will be final and binding upon you and Rite Aid. 

     

    PROCEDURES FOR MASS CLAIMS:  If 30 or more individuals initiate Notices or demands for arbitration against Rite Aid raising similar claims, and counsel for these individuals bringing the claims are the same or coordinated for these customers (“Mass Claims”), you and Rite Aid agree that if the claims are not resolved pursuant to the pre-dispute resolution process, then the Mass Claims shall proceed in arbitration in a coordinated proceeding. Counsel for these individuals and counsel for Rite Aid shall each select 5 cases to proceed first in arbitration in a bellwether proceeding. Additional cases shall not be filed in arbitration until the first 10 have been resolved, at which time 10 additional claims may be filed. If the parties are unable to resolve the remaining cases after the conclusion of the first bellwether proceeding, each side may select another 5 cases to proceed to arbitration for a second bellwether proceeding. This process may continue until the parties are able to resolve all of the claims, either through settlement, abandonment, or arbitration. Notwithstanding the class action waiver and arbitration agreement above, a court will have authority to enforce this clause and, if necessary, to enjoin the mass filing of arbitration demands against Rite Aid.

     

    OPT-OUT OF AGREEMENT TO ARBITRATE: You can decline this agreement to arbitrate by contacting Rite Aid through CT Corporation, 600 N 2nd Street, Suite 401, Harrisburg, PA 17101 and providing the requested information as follows: (1) your name; (2) the URL of these Rewards Terms; (3) your address; (4) your phone number; (5) and a clear statement that you wish to opt out of this arbitration provision in these Rewards Terms. This Opt-Out Notice must be mailed no later than 30 days after the date you first accept the Rewards Terms by using the website.

     

    CHOICE OF LAW/FORUM SELECTION: These Rewards Terms have been made, and shall be construed and enforced, in accordance with Pennsylvania law, without regard to any conflict of law provisions.  In any circumstances where the Dispute Resolution procedures set forth in this section permit the parties to litigate in court, these Rewards Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, excluding its conflict of law rules.  You further expressly consent and agree to submit to the exclusive jurisdiction and venue of the Court of Common Pleas for Cumberland County, Pennsylvania.

     

    SEVERABILITY:  If any provision of this Dispute Resolution section is found unenforceable, the unenforceable provision shall be severed, and the remaining terms shall be enforced.

     

    TERMINATION

     

    You can cancel your Rite Aid Rewards membership at any time by calling 1-800-RITEAID (1-800-748-3243). All accumulated BonusCash in your account will expire at the time of cancellation.

     

    Without notice to you, Rite Aid reserves the right to suspend or terminate your Rite Aid Rewards account, your participation in Rite Aid Rewards, and any Points, BonusCash, Offers or other benefits associated with your account, in whole or in part, if Rite Aid deems or suspects that you have engaged in or have attempted to engage in any of the following: acting in violation of these Rite Aid Rewards Terms; damaging, tampering with or corrupting the operation of Rite Aid Rewards; any unauthorized, deceptive, inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, unusual, or unlawful behavior or activity; using BonusCash for resale or commercial purposes, or activity deemed in the sole discretion of Rite Aid to be generally inconsistent with the intended operation of Rite Aid Rewards or the Rite Aid Rewards Terms. Any decision Rite Aid makes relating to termination or suspension of any Member’s participation in Rite Aid Rewards shall be final and binding in all respects. Rite Aid shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Rite Aid Rewards Terms or intent of these Rite Aid Rewards Terms. In the event that your participation in Rite Aid Rewards is terminated, all accumulated BonusCash in your account will expire on the date of such termination. Rite Aid may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. Rite Aid also reserves the right to deactivate any Rite Aid Rewards account that has not been used for twenty-four (24) consecutive months. 

     

    In some cases, you may still receive messages (which may have been scheduled prior to the account termination) after termination of enrollment in Rite Aid Rewards.

     

    MODIFICATION

     

    In its sole discretion, Rite Aid may cancel, change, suspend, or modify any aspect of Rite Aid Rewards at any time, including terms relating to the earning or redemption of BonusCash. The Rite Aid Rewards program will continue until terminated, suspended, or modified by Rite Aid. If Rite Aid makes changes to these Rite Aid Rewards Terms, the amended terms will be posted to this website, and the “Last Updated” date at the bottom of this page will be updated. Rite Aid may also, but is not required to, attempt to notify you in other ways. Unless Rite Aid indicates otherwise, the amended Rite Aid Rewards Terms will be effective immediately and your continued participation in Rite Aid Rewards, after the amended terms are posted, will confirm your acceptance of the changes.

THE LIMITATIONS IN THIS SECTION WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE(S).

     

    INDEMNIFICATION

     

    As a condition of participation in Rite Aid Rewards, you agree to indemnify, defend, and hold harmless Rite Aid, and its respective employees, directors, officers, agents, vendors and suppliers from and against any liabilities, losses, investigations, inquiries, claims, suits, damages, costs and expenses (including, without limitation, reasonable attorneys’ fees and expenses) arising out of or otherwise relating to your use of the services or your violations of these Rewards Terms.
